Sleeping tenant caught on camera in £135k property listing photos

HMO in PenrithA tenant has been photographed and filmed while asleep in bed in a property listed for sale in Penrith, Cumbria. The house is on the market with a guide price of £135,000.

The property is an HMO that is licensed for six occupants but is currently housing five tenants, according to the listing.

It generates a monthly rental income of £2,280, or £27,360 per annum. It could be equivalent to an 18% yield if the property is bought at the required price.

Rare chance

The business responsible for the publication of the photography and video is auction group Prime Property Auctions. It is being marketed as a “turn-key investment’ and a “rare, can’t-miss investment chance”.

The listing includes a walk-through video and a number of photos, including one of the bedroom where the tenant is in bed.

The video begins outside the Victoria terraced house (main picture). It is clear from the footage that the property requires some updating.

The kitchen and bathroom are filmed, before the camera is moved into the bedrooms, where the tenant was filmed and photographed.

Right to quiet enjoyment

Under Section 11(6) of the Landlord and Tenant Act 1985, landlords and agents should normally give at least 24 hours’ written notice before entering a property, with tenants having the ‘right to quiet enjoyment’, meaning they can reasonably refuse access.

According to the NRLA, communal areas in HMOs can be less restrictive, but tenants retain exclusive possession on their rooms, where stricter privacy protections apply.

The property is being sold at auction, where properties can often sell for more than the listing price.

Prime Property Auctions told The Neg: “The landlord just wants to sell the property, like any other landlord.”
