Failed property firm to pay £21,000 in unfair dismissal case

Sandstone UK Property Investment Ltd was told to pay compensation to a former employee, who was dismissed unfairly before the company went into liquidation.

Employment Tribunal

A property company has been ordered to pay a former employee nearly £21,000 for unfair dismissal.

But it is unclear how the award will be paid as the Scottish company went into liquidation last year and no longer trades, even though just two years ago it reported a turnover of £11.4 million that had increased 33%.

One of its directors, The Neg has discovered, has links to several other property firms in Scotland including a lettings agency.

An employment tribunal in Scotland ordered the compensation after hearing the facts of the case involving Sandstone UK Property Investment Ltd and an employee, Angela Kirkwood.

Loss of earnings

Judge Jones said: “The respondent [Sandstone] entered into compulsory liquidation on 7 August 2023 and had the claimant [Ms A Kirkwood] not been unfairly dismissed prior to that date, she would have been dismissed on that date.

“Compensation is therefore only awarded in respect of the claimant’s loss of earnings from the date of her dismissal to the date of compulsory liquidation of the respondent.”

The total award of £20,893 was made up from loss of earnings £17,909, and loss of pension benefit of £2,984.

Redundancy

Recently, a Winkworth franchise in Worthing, West Sussex, was ordered to pay a senior sales negotiator more than £10,600 for unfair dismissal, which included a redundancy payment.

And Preston estate agency Michael Bailey was told to pay a former sales and business support manager £28,000 following an unfair dismissal case.
