Estate agency to pay former negotiator £46,000 over discrimination

Statons of North London and Hertfordshire "sidelined" Paige Rose because of a serious illness, a tribunal found.

Estate agency Statons has been ordered to pay a property consultant more than £46,600 for disability discrimination and unfair dismissal.

Paige Rose, who worked for the North London agent for nearly seven years, suffered from Crohn’s Disease and had operations to treat the condition.

An employment tribunal found that the estate agency “knew better”, but used her illness to “sideline her within the business”.

Rose said she felt “belittled” by the way the company had treated her, and that this had a significant impact on her.

Injury to feelings

She was awarded £46,652, including £25,000 for ‘injury to feelings’.

“The Tribunal found that the claimant had been constructively unfairly dismissed, and had been the subject of disability discrimination, primarily under section 15 of the Equality Act 2010.

“We note that the respondent [Statons] was aware that she was recovering from a flare up of her Crohn’s disease, and had had two recent serious operations,” it said.

Sideline

“The respondent knew better, and had chosen to use the claimant’s illness to sideline her within the business.”

Rose worked as a sales negotiator, lettings negotiator and senior lettings negotiator for more than five years at the estate agency, which has six offices in North London and Hertfordshire. She left the company last year.
