Latest mandatory How to Rent guide published this morning

A new version of the legally mandatory renting checklist is issued by the Government, six months after the last one was printed.

Agents will be required to serve this most recent version of the guide, and if they don’t evictions can be difficult or impossible.

Information on the Housing Loss Prevention Advice Service is detailed in the new version. It replaces the Housing Possession Court Duty Schemes (HCPDS), which provides legal advice to tenants at risk of eviction.

How to rent

The How to Rent guide is for tenants and landlords in the PRS in England to help them understand their rights and responsibilities.

It provides a checklist and more detailed information on each stage of the process, including: what to look out for before renting; living in a rented home; what happens at the end of a tenancy, and what to do if things go wrong.

Delayed

The last version issued in late March included information on Smoke and Carbon Monoxide Alarm (Amendment) Regulations 2022, and changes to the Code of Practice on Right to Rent Civil Penalty Scheme for landlords and agents.

It was delayed a week, leaving agents confused as the Department of Levelling Up Housing and Communities (DLUHC) website was still offering a version from December 2020 on the advertised day of publication.

Shambles

The delay was described as a shambles by one agent, as tenants would be able to use it as a defence against a Section 21 eviction.

DLUHC defended the delay, saying it was working to ensure the guide was accurate.

  1. My opinion is the document is completely unneccessary.

    I discinctly remember Cameron saying – when he became PM – we will have a bonfire of regulations.

    Then they brought this piece of ***p (Rubbish) out, along with everythign else that is causing Landlords to quite the market in droves. Anyone who does not believe that – needs to do more work on the subject.
