HAVE YOUR SAY: RICS consultation opens on tougher block management code
RICS says new rules will weed out rogue managing agents and increase professionalism within the sector.

RICS has jointly launched a consultation on its much-anticipated ‘best practice’ code issued for managing agents designed to improve professionalism across the sector.
The code, which will be launched jointly with The Property Ombudsman (TPO) will also help root out rogue agents and improve transparency for all parties.
It has been developed by The RoPA Code of Practice Steering Group – led by Baroness Dianne Hayter – and follows recommendations from Lord Best’s RoPa report.
The Block Management Sector Code is set to improve the sector for consumers and those working within it by setting out ‘clear standards and principles for all agents involved in the management of leasehold and commonhold property, and estates of freehold houses’.
Despite a primary focus on England, RICS is looking for managing agents, homeowners and tenant input from across the UK. The code will introduce:
- increased transparency over service charges and management fees;
- support for how to deal with occupier disputes;
- recognising consumers’ use of social media and guidance on how best to work with residents’ associations in new and diverse ways;
- updated complaints processes;
- clear instructions on best practice for securing new business.

“Anything that brings greater understanding of the respective rights and duties that exist between landlords and lessees must be welcomed.”
Peter Habert (pictured), TPO Director of Policy, says: “This consultation is important as it provides the opportunity, not just for managing agents to have their say, but for leaseholders and freeholders to share their views to on what they consider a fair and reasonable service should look like”.
The consultation is open until 14 September 2021.
